1. About These Terms
These Terms and Conditions ("Terms") govern your use of the Middle Brother Group website at mbgroup-au.com and any services provided by Middle Brother Group ABN 11 659 563 872 ("MBG", "we", "us", "our"). By using our website or engaging our services, you agree to these Terms.
2. Services
MBG provides industrial product sourcing, procurement, supply, consulting and logistics services. All services are subject to a separate written agreement or accepted quote. These Terms apply in addition to any such agreement. We reserve the right to decline any enquiry or order at our discretion.
3. Quotes and Orders
All quotes provided by MBG are valid for the period stated on the quote. Prices are subject to change based on supplier pricing, exchange rates and freight costs. An order is confirmed only upon written acceptance by MBG.
4. Payment
Payment terms are as stated on the invoice or agreed quote. MBG reserves the right to require a deposit prior to commencing procurement. Overdue accounts may incur interest and recovery costs.
5. Delivery and Logistics
Delivery timeframes are estimates only and are subject to supplier availability, freight schedules and customs clearance. MBG will use reasonable endeavours to meet agreed delivery dates but is not liable for delays outside our reasonable control. Risk in goods passes to the customer upon delivery to the agreed delivery point. Title passes upon receipt of full payment.
6. Returns and Cancellations
Returns and cancellations are subject to supplier terms and conditions. Specially sourced, custom or imported items may not be returnable. Please contact us at [email protected] to discuss your situation before returning any goods.
7. Limitation of Liability
To the maximum extent permitted by law, MBG's liability for any claim arising from our services is limited to the value of the relevant order. We are not liable for indirect, consequential or special loss or damage. Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.
8. Intellectual Property
All content on this website, including text, images, logos and branding, is the property of Middle Brother Group or its licensors. You may not reproduce or use any content without our written permission.
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
